UNDER and by virtue of the authority contained in a Deed of Trust dated
April 7, 2006 and recorded among the Land Records of Baltimore City,
Maryland in Liber 7657 at Folio 613, granted by Steven A. Booth to the
trustee named therein, Robert C. Brendel, with all of the powers granted
to the trustee named therein, including a power of sale upon default,
and default having occurred in the terms and conditions thereof, the
said Trustee will sell at public auction at the Courthouse entrance of
the
CIRCUIT COURT FOR BALTIMORE CITY,
AT
THE CIRCUIT COURTHOUSE BUILDING
100 NORTH CALVERT STREET
BALTIMORE, MD 21202
JULY 5, 2007 at 10:00 a.m.
All that fee simple property described in said Deed of Trust, as
follows:
BEGINNING FOR THE SAME, on the Southern side of Elison Avenue at the
distance of 822 and 85/100ths feet easterly measured along the Southern
side of Elison Avenue from the Northeastern side of Parkside Drive which
place of beginning is at a point in line with the center of a partition
wall there erected and running thence Easterly binding on the Southern
side of Elison Avenue 16 feet to a point in line with the center line of
another partition wall there erected, thence running Southerly to,
through and along the center line of said last mentioned partition wall
to the end thereof and continuing the same course in all 100 feet to the
Northern side of an alley 16 feet wide there situate , thence running
Westerly on the Northern side of said alley with the use thereof in
common with others 16 feet to meet a line drawn Southerly from the place
of beginning to, through and along the center line of the partition wall
first mentioned in the description, thence running Northerly reversing
said line so drawn and binding thereon 100 feet to the place of
beginning. The improvements thereon being known as No. 4773 Elison
Avenue.
SAID LAND AND PREMISIES being in the Second Election District of
Baltimore City, Maryland and being improved by a dwelling bearing the
street address of 4773 Elison Avenue, Baltimore, Maryland 21206. Subject
to all covenants, restrictions and easements of record, if any.
TERMS OF SALE: A cash or cash equivalent deposit of Twenty Thousand
Dollars and No Cents ($20,000.00) will be required at the time of sale,
the balance to be payable in cash within ten (10) business days after
ratification of the sale by the Circuit Court for Baltimore City,
Maryland, with interest on said balance from the date of sale to the
date of settlement at the rate of 14.95% per annum. Failure of the
purchaser to settle will result in resale of the property at the risk
and cost of the purchaser, or forfeiture of deposit at the election of
the Trustee, who specifically preserves all legal and equitable remedies
available to them. The Trustee reserves the right to waive the deposit
requirements if the noteholder is the purchaser. Property will be sold
"SUBJECT TO" a superior first mortgage, Recorded among the Land Records
of Baltimore City, Maryland, in Liber 7654 at Folio 179, held by Fremont
Investment and Loan, a California Corporation, whose post office address
is 2727 East Imperial Highway, Brea, CA 92821, having an approximate
principal balance of EIGHTY SEVEN THOUSAND DOLLARS AND NO CENTS
($87,000.00). Sale is "AS IS" and Trustee makes no warranty of any kind
whatsoever regarding the physical condition, physical description, or
title to the property. Taxes, rent, annually payable public charges and
assessments, including the front foot benefit charges of the appropriate
governing agency, if any, and condominium fees and/or homeowners
association dues, if applicable, will be adjusted to the day of sale and
thereafter assumed by the Purchaser. All costs of conveyancing,
including transfer taxes and recordation taxes will be paid by the
Purchaser. The purchaser's sole remedy in the event the Trustee is
unable to convey marketable title is the return of the deposit. Upon
return of the deposit, the sale shall be null and void.
